Lake Simcoe Angler Fined $6,500 for Fishing Under Suspension
A Toronto man has been fined $6,500 for a number of fishing offences.
Lubomyr Nalesnik, 58, was convicted of contravening a court order, making a false statement to a conservation officer, unlawfully using another person’s licence and catching an over quota of whitefish. In addition to the fine, his fishing licence is suspended for five years, and he was placed under probation for a period of two years.
Court heard that on January 31, 2009, Nalesnik was angling on Lake Simcoe in Innisfil Township when a conservation officer observed him with one whitefish over quota. He produced a fishing licence which had his correct date of birth, but had been issued in another person’s name. Further investigation showed that Nalesnik had been previously convicted of fishing violations and suspended from fishing for a period of two years commencing April 8, 2008. On May 5, 2008, he purchased a fishing licence and outdoors card using a fictitious name and his own date of birth.
Justice of the Peace Montgomery Lynn heard the case in Ontario Court of Justice, Barrie, on June 15, 2009.
