AGGREGATES PIT OPERATION FINED $10,000 FOR EXCESSIVE PRODUCTION

A Listowel couple was convicted of failing to operate a pit in accordance with the Aggregate Resources Act in the Municipality of Brockton. Harry Donnegan was fined $10,000 and Jeanette Donnegan received a suspended sentence.

The Donnegans operate a licensed aggregate pit with an annual extraction limit of 65,000 tonnes. They were convicted for extracting 139,320 tonnes more than their production limit in 2007. Tonnage conditions are placed on aggregate licences to help reduce the impact of a pit or quarry operation in an area, including truck traffic on neighbouring residents and additional wear on municipal roads.

Justice of the Peace Bridgette Forster heard the case in the Ontario Court of Justice, Walkerton, on June 2, 2009.
